The Social Security Administration has strict guidelines in regards to what “qualifies” as a disability. With so many SSD applications, it has become increasingly difficult for an injured person to reach a favorable outcome in the application process. You may be wondering how SSA defines disability or if your injury qualifies. In order for a person’s injury to fit their strict definition of a “disability,” it must meet the following guidelines:

  • You are unable to perform your previous occupation;
  • You cannot perform other work because of your medical condition; and
  • Your medical condition either must last for a minimum of one year or it must be expected to last a year and/or result in death.
The Application Process

A widely-known fact is that getting approved for Social Security Disability is a long and drawn-out process. The last thing you would want to do is spend a lot of time pouring over paperwork and waiting, only to be denied over an administrative error on your behalf. One of the reasons that the process takes so long is because the Social Security Administration has had a significant amount of fraudulent claims in the past. Such claims have cost the SSA a great deal of money and time, exhausting their resources. For this reason, it is absolutely essential that you file your Social Security Claim properly without any errors if you want to have the greatest chances of getting your application approved.


The majority of all Social Security disability applications are denied, even in cases where the injured person has a strong case. In fact, the SSA may be so bold as to deny a valid claim in hopes that you will give up and fail to pursue an appeal. Since so many claims are denied at the initial stage, the SSA allows just 60 days for you to appeal their decision. Once you appeal, your claim will enter what is referred to as the Reconsideration stage of the process. Of those appeals in reconsideration, the SSA will reject more than 85% of them; however, you have the right to request a hearing in front of an Administrative Law Judge. This hearing is extremely crucial to the outcome of your case and having a competent attorney can substantially increase your chances of being approved during this stage.
